附带民事诉讼是由刑事诉讼派生的，是在追究行为人的刑事责任的同时，附带追究行为人的损害赔偿责任。因此，附带民事诉讼必须以刑事诉讼的成立为前提，如果刑事诉讼不成立，附带民事诉讼就失去了存在的基础。
